Will the Health Care Reform Law Stand in Court?

The 2010 Patient Protection and Affordable Care Act, the Obama administration’s principal health care reform legislation, faces a serious test next week as oral arguments begin in front of the U.S. Supreme Court in Florida v. United States Department of Health and Human Services. The issue at stake is whether parts of the act will hold up under constitutional scrutiny, specifically the health insurance mandate that is scheduled to take effect in 2014. If the Supreme Court overturns the mandate, the subsequent effects could change the balance of power in government.

In an event hosted on FORA.tv by the National Constitution Center, “A Moot Court: Health Care on Trial” featured arguments for and against the health care mandate, as well as other provisions in the Affordable Care Act, and was presided over by several distinguished federal judges, law professors and other legal thinkers:
